Valild law:
On the October 15th, 2008, the chamber of deputies has dismissed a new law about the Luxembourgish citizenship which came into effect on the 1st of January 2009. This new law about the "double" citizenship intends the candidate must not renounce any more on his former citizenship while accepting the Luxembourgish one (please see also the website of the Ministry of Justice http://www.mj.public.lu/).

Acquiring the Luxembourgish citizenship through naturalization

 

 

 

The naturalization awards the candidate of all civil and political rights of a Luxembourgish citizen.

 

 

Important items are:

·    the double nationality is allowed from now on

·    the candidate must be at least 18 years old the day of his application

·    the minimal term of the obligatory residence in the country amounts to 7 consecutive years

·    the candidate has to settle down effectively in the country, therefore, he must dispose of an official stay certificate for the country of Luxembourg

·    he has to dispose of required honour

·    he has to provide evidence of the required linguistic knowledge

·    he has to successfully complete the civil courses (or dispose of a dispensation)

 

 

Honour

 

 

 

The candidate has to prove sufficient guarantees regarding his honour. The act can be closed for a certain time, if the candidate for the naturalization is part of a criminla judiciairy procedure.

Linguistic knowledge

The following competences are to acquire:

Understanding of the language: Learning step B1 (CEFR)
Oral expression:                      Learning step A2 (CEFR)

 

 

Summarized, the candidate must be able to participate in the social and political life in Luxembourg. The candidate for the naturalization must prve sufficient active and passive knowledge of at least one of the prescribed languages, which are noted in the law from February 24th, 1984 about the application of languages. The candidate has to pass successfully a liguistic test in the Luxembourgish language.

Dispensed from the participation to this language test are:

 

 

·    those who passed their 7 years of education in Luxembourg, this under the frame of the education of the Luxemburgish state education or a private education which respects the school program of the Luxembourgish state education;

·    those who disposed of a residence permit for the country of Luxembourg before December 31th, 1984, and who are resident since then in Luxembourg.

Civil instruction

 

 

The candidate has to graduate the civil instructions, which allow him to dispose about the required knowledge of the Luxembourgian institutions and foundamental rights of Luxembourg.

The candidate for the naturalization must pass at least 3 civil courses:

·     one course regarding the Luxemburgish Institutions

·     one course about the fundamental rights

·     one course, where the candidate can option between the following themes: History, Municipality, social security and media.

 

 

Dispensed from these courses are those persons, who are not obliged to participate on the successful language tests of the spoken Luxembourgish language.

What needs to be undertaken in order to the naturalization?

First, you have to pass in a naturalization request at the municipality of your place of residence and to join the following documents:

 

 

·    Birth certificate of the candidate and the children;

 

 

·    forms / conscientiously set up biographic note;

 

 

·    a residence certificate of your municipality;

 

 

·    a certified copy of your passport;

 

 

·    an extract from the Luxembourgish criminal record and and a similar document, which was issued by the responsible authorities of the countries in which the candidate has lived since his age from 18 years and which covers the last 15 years before submitting the naturalization request;

·    a certificate of successful participation on the linguistice test regarding the spoken Luxembourgish language (*);

 

 

·    a certificate of participation to the courses about the foundations of the Luxembourgish State (*).

All papers and documents have to be translated by an accredited translator in the French or German language.
